End User Licence Agreement

This agreement is between you and Simon Jacobsen (“we”, “us”). It covers the ash launcher and the ash client (together, “ash”). By installing or using ash you accept it. If you do not accept it, do not use ash.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use ash for your own use. We keep all rights we do not expressly grant you here.
2. What you need
ash requires a Microsoft account holding a valid licence for Minecraft: Java Edition. ash does not provide Minecraft, does not grant any right to play it, and cannot be used without your own licensed copy. Your use of Minecraft is governed by your agreement with Mojang and Microsoft, not by this one.
3. What you may not do
- Use ash to gain an unfair advantage in multiplayer play, or to circumvent any anti-cheat system.
- Reverse engineer, decompile or modify ash, except where that right cannot lawfully be excluded.
- Redistribute, resell or sublicense ash.
- Use ash unlawfully, or to infringe anyone else’s rights.
- Share, transfer or resell your account credentials or any entitlement associated with your account.
4. Your account
You are responsible for activity under your account and for keeping your credentials secure. We may suspend or terminate access to ash, and to any associated account, if you breach this agreement.
5. Purchased items
Any cosmetic or other item you obtain through ash is licensed to you, not sold. It has no monetary value, cannot be exchanged for money or transferred to another person, and may be modified or withdrawn. Items exist only within ash and do not affect gameplay.
6. Changes and availability
We may change, suspend or discontinue ash, or any part of it, at any time. We may update this agreement; if we do, we will post the updated version here and change the date above. Continued use after a change means you accept it.
7. No warranty
ASH IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ASH WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL OR GAME PROGRESS, ARISING OUT OF OR RELATING TO YOUR USE OF ASH. NOTHING IN THIS AGREEMENT EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.
9. Microsoft
ash uses Microsoft’s identity platform to sign you in. MICROSOFT CORPORATION AND ITS AFFILIATES MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, IN RESPECT OF ASH, AND EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. MICROSOFT AND ITS AFFILIATES HAVE NO LIABILITY OF ANY KIND ARISING OUT OF OR RELATING TO ASH OR YOUR USE OF IT.
Microsoft is not a party to this agreement, is not responsible for ash, and provides no support for it. We are solely responsible for ash and for supporting it.
10. Not an official Minecraft product
ash is not affiliated with, endorsed by, or connected to Mojang AB, Mojang Studios or Microsoft Corporation. Minecraft is a trademark of Mojang Synergies AB. All trademarks are the property of their respective owners, and our use of them does not imply any endorsement.
11. Termination
You may stop using ash at any time by uninstalling it. This agreement ends when you do. Sections 7 through 10 survive termination.
12. Governing law
This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to conflict of law principles. The courts of the Province of Ontario have exclusive jurisdiction over any dispute arising from it.
